We acted for a serving member of the armed forces. He and his wife were married for 8 years, although the husband had been a serving member of the armed forces for 20 years.
On divorce, the wife wanted a 50% pension sharing order in relation to her husband’s pension, meaning 50% of his lump sum on retirement and 50% of the income on retirement for life. Following negotiations, we persuaded the wife to accept a lump sum of £10,000 payable when the husband receives his lump sum on retirement.
This means that the husband retained the remainder of his lump sum on retirement and his income on retirement for life in full.
