Any agreement that is reached between parties (i.e. not imposed by the Court) has a far greater chance of success in the long run, because mediation also gives the opportunity for people to talk about what has gone wrong in the past and how that can be improved in the future. The law also now requires you to attend mediation before issuing an application with the Court, and the mediators have to file and sign a form indicating that you have attempted mediation.
